Terms of Use

1. Scope

Namecontrol is a marketplace where buyers and sellers trade domain names. We are not the owner of the domains offered but act as intermediary and escrow agent.

2. Account and registration

Buying or selling a domain does not require a permanent account. All information required for the transaction is transmitted encrypted and used solely for contract processing.

You warrant that all information you provide is true, complete and up to date.

3. Purchase flow and escrow

Purchases can be made at the fixed price or via an offer. Once payment is received, Namecontrol guides the transfer of the domain to the buyer's registrar.

The seller is only paid out after the domain has verifiably arrived at the buyer. Until then, Namecontrol holds the purchase price in escrow.

4. Prices, payment and invoices

All prices shown are net; statutory VAT is added and displayed at checkout.

After a successful transaction the buyer automatically receives a proper invoice by email.

5. Right of withdrawal

Domains are digital content provided immediately and individualised. Consumers therefore expressly waive their right of withdrawal upon confirming immediate performance, as permitted under applicable law.

6. User obligations

You agree not to use the platform for unlawful purposes, not to infringe any third party trademark or name rights, and not to offer domains you do not fully own.

7. Liability

Namecontrol is liable without limitation for intent and gross negligence and under the German Product Liability Act. For slight negligence, we are only liable for breaches of essential contractual duties and only for foreseeable damage typical of the contract.

8. Changes to these terms

We reserve the right to adapt these Terms of Use where legally or operationally required. We will notify you of material changes in good time.

9. Applicable law and jurisdiction

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Munich.
